This website is operated by Bajolek & Co Pty Ltd (ABN 59 677 763 594; ACN 677 763 594), trading as Bajolek Clothing Co. “Bajolek”, “we”, “us” and “our” refer to that company. By using this website or placing an order, you agree to these terms.

Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

Products

We take reasonable care with product descriptions, images, sizing and colours. Screens display colour differently and production batches may vary slightly. The product supplied will be governed by its confirmed description and approved production specification. Follow the care label supplied with the garment.

Prices, tax and payment

Prices are shown in Australian dollars unless another currency is displayed at checkout. Bajolek & Co Pty Ltd is not currently registered for GST, so Australian prices do not include a GST component. We will update this statement if our registration changes.

Available payment methods and final delivery charges are shown at checkout. Payment is normally taken when an order or pre-order is placed. An automated confirmation acknowledges receipt; we accept your order when we confirm dispatch. If we cannot accept or supply an order, we will contact you and refund the affected amount.

Pre-orders

Pre-order items are not ready for immediate dispatch. The current estimated dispatch date is shown on the product page and at checkout. You may cancel an unfulfilled pre-order before it enters dispatch. If timing changes materially, we will provide an update and the available options.

Promotions and sets

Promotions, discount codes and package prices are subject to the conditions shown with the offer. Discounts have no cash value. The treatment of returns from discounted sets is explained in our Returns & Refunds Policy.

Delivery and returns

Delivery regions, charges and current pre-order information are in our Shipping & Delivery Policy. Our Returns & Refunds Policy explains voluntary returns and statutory remedies. Please provide complete and accurate order and delivery information.

Website use

Use this website lawfully and do not interfere with its security, operation or other customers. Product information and availability may be corrected or updated before an order is accepted. If a genuine error affects an order, we will contact you and provide an appropriate option, including a refund where required.

Intellectual property

The Bajolek name, crowned-B artwork, product designs, photographs, copy and other original website content may not be copied, altered, republished or commercially used without written permission, except as permitted by law. Third-party marks remain the property of their owners.

Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss caused solely by use of this website. This does not limit liability or remedies that cannot lawfully be limited.

Changes and governing law

We may update these terms for future use of the website and future orders. The version applying to an accepted order is the version available when that order was placed. These terms are governed by the laws of Queensland, Australia, while any mandatory consumer rights in your location continue to apply.
